Terms of Use

1. Acceptance of Terms

By downloading, installing, or using poly ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Giuseppe Cosenza ("we," "us," or "our"), the developer of poly

2. License to Use

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use poly on Apple devices that you own or control, solely for your personal, non-commercial purposes.

This license does not include any right to: sublicense the App to others; use the App for commercial purposes without our prior written consent; or make the App available over a network where it could be used by multiple devices at the same time.

3. Intellectual Property

poly, including its name, logo, design, film filter algorithms, branding, and all associated content, is owned by Giuseppe Cosenza and is protected by Italian and international intellectual property laws, including copyright, trademark, and trade secret law.

You may not copy, modify, distribute, sell, or lease any part of the App or its content, nor may you reverse engineer or attempt to extract the source code of the App, unless applicable laws expressly permit you to do so or you have our written permission.

4. Premium Subscription & In-App Purchases

poly offers optional Premium features through the following purchase types, all processed via Apple's In-App Purchase system (StoreKit):

• Monthly subscription — auto-renews monthly unless cancelled.
• Yearly subscription — auto-renews annually unless cancelled.
• Lifetime purchase — a one-time payment that grants permanent access.

Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel subscriptions at any time in Settings › Apple ID › Subscriptions.

All prices are set in the App Store and may vary by region. We do not handle billing directly; all charges are processed by Apple. Refunds are subject to Apple's refund policies and applicable consumer protection law. We do not offer refunds outside of what Apple requires.

Premium features are tied to your Apple ID. They are accessible on any device signed in with the same Apple ID via the "Restore Purchases" function in the App.

5. User Content

All photos, videos, time lapses, and captions you create using poly ("User Content") remain entirely yours. We claim no ownership over your User Content and have no access to it.

You are solely responsible for ensuring that your use of the App and any content you create complies with applicable laws, including laws governing privacy, publicity rights, and copyright.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Circumvent, disable, or otherwise interfere with security-related features of the App, including features that prevent or restrict use or copying of any content.
• Use the App to create, store, or distribute content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Attempt to gain unauthorized access to Premium features without purchasing them.
• Use any automated means to access the App or its features in an unauthorized manner.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or reliability of any results obtained through use of the App.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GIUSEPPE COSENZA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

IN ANY CASE, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR ANY PREMIUM PURCHASE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of Italy.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws applicable in your country of residence.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice or liability, if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate these Terms at any time by uninstalling the App from your device and cancelling any active subscriptions through the App Store.

12. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through the App or the App Store page. Your continued use of poly after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please stop using the App and cancel any active subscriptions.
